DecisionPro Privacy Policy

This Privacy Policy describes how DecisionPro, Inc. (“DecisionPro,” “we,” “us” or “our”) collects, uses and shares the information of persons and companies (“user,” “you” or “your”) that access, download from or otherwise use our website at “www.enginius.biz” (the “Website”) or any of our services and related software and documentation (the “Services”).

When you access or use our Website or Services, you acknowledge that you have read and understand this Privacy Policy. Your use of our Website and Services is subject to this Privacy Policy and our Terms of Use (including any applicable limitations on damages and the resolution of disputes). We may update this Privacy Policy at any time as we deem appropriate. You periodically should check back and make sure that you have reviewed the most current version of our Privacy Policy.

This Privacy Policy applies to all users of our Website and Services anywhere in the world. Some users, including residents of the European Union/European Economic Area, may have additional rights depending on where they are located, which are described in this Privacy Policy.

  1. INFORMATION WE COLLECT. We collect some information you provide directly to us and some we collect automatically. “Personal Information” refers to data that could be used, alone or in combination with other data, to identify you as an individual. For example, we may collect information when you purchase a product or service, create an account, fill out a form, request customer service, or otherwise communicate with us.

The types of Personal Information you may provide include:

    • Contact information (such as name, email address, mailing address, and phone number);
    • Payment information (such as billing address and bank account information); and
    • Account log-in credentials (such as user names).

In addition, we automatically collect information about your interactions with the Website and the Services, as well as the devices that you are using to access, download or use the Website and Services, as follows:

    1. We collect a log of what models you have utilized on Enginius. In the case of academic users, this data my be provided to the course instructor at their request.
    2. Reports you generate are stored in your account for a maximum of 30 days. You can delete such reports anytime you choose.
    3. We use the reCAPTCHA service provided by Google Inc. (“Google”) to protect your information that you submit via submission forms on the Website. This plugin checks if you are a person in order to prevent certain Website functions from being (ab)used by spam bots. This plugin query includes the sending of the IP address and possibly other data required by Google for the Google reCAPTCHA service. For this purpose your input will be communicated to and used by Google. However, your IP address is previously truncated by Google within member states of the European Union or in other states which are party to the agreement on the European Economic Area and is, as such, anonymized. Only in exceptional cases is a full IP address transmitted to a Google server in the United States and truncated there. On behalf of DecisionPro, Google will use this information to evaluate your use of the Website. The IP address provided by reCaptcha from your browser shall not be merged with any other data from Google. This data collection is subject to the data protection regulations of Google (Google Inc.). By using the reCAPTCHA service, you consent to the processing of data about you by Google in the manner and for the purposes set out above.
  1. NO SHARING OF YOUR INFORMATION. We never share any Personal Information with any party or organization or partner outside of DecisionPro, except as follows:
    • To legal, governmental, or judicial authorities as instructed or required by those authorities and applicable laws, or in relation to any alleged illicit or illegal activity, such as in response to a subpoena or investigation of suspected illicit or illegal activities, or where we believe in good faith that users may be engaged in illicit or illegal activities, or where we are bound by contract or law to enable a customer or business partner to comply with applicable laws;
    • In connection with, or during negotiations for, an acquisition, merger, asset sale, or other similar business transfer that involves all or substantially all of our assets or functions where Personal Information is transferred or shared as part of the business assets (provided that such party agrees to use or disclose such Personal Information consistent with this Privacy Policy or gains your consent for other uses or disclosures);
    • With your consent or at your direction, such as when you choose to share information or publicly post content and reviews (for example, social media posts); and
    • With persons of your choosing and at your discretion, should the Website or the Services allow that functionality.

We may also share aggregate data that does not identify you or any specific device with third parties.

  1. PROTECTION OF YOUR PERSONAL INFORMATION. We use administrative, organizational, technical, and physical safeguards to protect the Personal Information we collect and process. Our security controls are designed to maintain data confidentiality, integrity and an appropriate level of availability.
  1. INDIVIDUAL RIGHTS IN PERSONAL DATA. In accordance with applicable law, you may have the right to: (i) request confirmation of whether we are processing your Personal Information; (ii) obtain access to or a copy of your Personal Information; (iii) receive a portable copy of your Personal Information, or ask us to send that information to another organization (the “right of data portability”); (iv) seek correction or amendment of inaccurate, untrue, incomplete, or improperly processed Personal Information; (v) restrict our processing of your Personal Information; (vi) object to our processing of your Personal Information; and (vii) request erasure of Personal Information held about you by us, subject to certain exceptions prescribed by law.

If you would like to exercise any of these rights, please contact us as set forth below. We will process such requests in accordance with applicable laws. To protect your privacy, we may take steps to verify your identity before fulfilling your request. For some requests and where permitted by law, an administrative fee may be charged. We will advise you of any applicable fee prior to performing your request.

  1. RETENTION OF PERSONAL INFORMATION. We will keep your Personal Information for the minimum period necessary for the purposes set out in this Privacy Policy, namely (i) for as long as you are a registered subscriber or user of our Website, Services and related services, (ii) for as long as your Personal Information are necessary in connection with the lawful purposes set out in this Privacy Policy, for which we have a valid legal basis, or (iii) for as long as is reasonably necessary for business purposes related to provision of the Website, Services and related services, such as internal reporting and reconciliation purposes, warranties or to provide you with feedback or information you might request. In addition, if any relevant legal claims are brought, we may continue to process your Personal Information for such additional periods as are necessary in connection with that claim. Once the abovementioned periods, each to the extent applicable, have concluded, we will either permanently delete, destroy or de-identify so that it can no longer reasonably be tied to you.

  2. DATA TRANSFERS. We are headquartered in the United States and have operations and provide services in the United States and throughout the world. As such, we and our service providers may transfer your Personal Information to, or store or access it in, jurisdictions that may not provide equivalent levels of data protection as your home jurisdiction. We will take steps to ensure that your Personal Information receives an adequate level of protection in the jurisdictions in which we store and process it.

  3. RESIDENTS OF THE EUROPEAN UNION/EUROPEAN ECONOMIC AREA. If you are in the European Union (“EU”) or the European Economic Area (“EEA”), the following additional disclosures apply: (a) DecisionPro, Inc. acts as the Controller of your Personal Information, (b) when we process your Personal Information, we will only do so in the following situations: (i) we need to use your Personal Information to perform our responsibilities under our obligations with you (e.g., processing payments for and providing the Services and related services you purchase or request); (ii) we have a legitimate interest in processing your Personal Information (for example, we have a legitimate interest in processing your Personal Information to provide, secure, and improve our Website, Services and related services, in communicating with you about the Website, Services and related services, and in informing you about new services or products; (iii) we have your consent to do so; or (iv) we need to process your Personal Information to comply with our legal obligations. You may contact us to submit a request to exercise your rights in Personal Information. If you initially consented to our processing of your Personal Information, you may contact us to withdraw your consent. If you are an EU/EEA Data Subject and have a concern about our practices concerning the processing of Personal Information that we are not able to resolve, you have the right to lodge a complaint with the data protection authority where you reside or in which you work, or in which the alleged infringement occurred, each as applicable.

  4. RESIDENTS OF CALIFORNIA

a. SHINE THE LIGHT LAW. We do not share information that identifies you personally with non-affiliated third parties for their own marketing use without your permission.

b. CALIFORNIA CONSUMER PRIVACY ACT. If you are a resident of California, you may contact us to submit a request to exercise your rights in Personal Information. For purposes of the California Consumer Privacy Act, we do not “sell” your Personal Data.

  1. LINKS TO OTHER WEBSITES. Our Website, Services and related services may contain links to other websites for your convenience and information. These websites may be operated by companies not affiliated with us. Linked websites may have their own privacy policies or notices, which we strongly suggest you review if you visit those websites. We are not responsible for the content, privacy practicesor use of any websites that are not affiliated with us.
